The petitioners are apprehending their arrest in connection with Fatehpur P.S. Case No.226 of 2014 for allegedly having committed the offences under Sections 323, 341, 427 and 504/34 of the Indian Penal Code and under Section 27 of the Arms Act.
It is submitted on behalf of the petitioners that the informant and these petitioners are agnates and it is on account of old land dispute that the present case has been lodged against the petitioners making false and frivolous allegations. Considering the nature of the allegations and also the fact that there is no recovery of any arms or any specific injury
Patna High Court Cr.Misc. No.43419 of 2014 (2) dt.20-03-2015 2/2 has been attributed to these petitioners, let both the above named petitioners, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Gaya, in connection with Fatehpur P.S. Case No.226 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
