====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 02-04-2019 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Ghoshi P.S. Case No.402 of 2018, registered for the offence punishable under Section 7 of Essential Commodities Act.

It is alleged that the petitioner is a PDS Dealer and the informant, who is Block Supply Officer, has made a verification of the Stock and found about 9.5 quintals of wheat and 18 quintals of rice in his shop in spite of the fact that on 7.10.2018 altogether 32.94 quintals of wheat and 49.41 quintals of rice had been delivered to the shop of the petitioner and it is not possible to distribute such a huge quantity till 11.00 A.M on

Ration Card of beneficiaries were also kept by the said dealer. Due to the irregularities and black marketing, this case has been lodged against the petitioner.

Learned counsel for the petitioner submits that all the persons attached with his shop, who have been examined, have not alleged any irregularity in supply of food grains by the petitioner. The petitioner has got no criminal antecedent. Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Sub-Judge-1, Jehanabad in connection with Ghoshi P.S. Case No.402 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with a further condition that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation.
