====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 09-05-2025 Heard learned counsel for the petitioner as well as learned APP for the State.

2. In this case, the petitioner is seeking regular bail in connection with Hisua P.S. Case No. 151 of 2024, registered for the offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act, 2016.

3. As per allegation, 385 litres of country-made liquor was recovered from wheat field of the petitioner.

4. Learned counsel for the petitioner while making prayer for bail has submitted that earlier the bail application of the petitioner was rejected vide order dated 21.08.2024 in Cr. Misc. No. 58240 of 2024. While rejecting the bail application, it was observed that the petitioner may renew his prayer for bail

Patna High Court CR. MISC. No.18843 of 2025(2) dt.09-05-2025 2/2 after six months from today. The stipulated period has already been completed and the petitioner has remained under custody for near about eight months.

5. On the other hand, learned APP for the State opposes the prayer for bail of the petitioner.

6. Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge-Ist, Nawada in connection with Hisua P.S. Case No. 151 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
