JUSTICE SANJAY PRIYA ORAL ORDER 2/ 31-10-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in Garkha P.S. Case No.274 of 2016 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code and Section 27 of the Arms Act pending in the Court of the Additional Chief Judicial Magistrate, V, Saran at Chapra.

Prayer of the petitioner for bail was earlier rejected by this Court on merit by order dated 19.04.2017 passed in Cr. Misc.No.113 of 2017.

This Court finds that aforesaid order was passed on merit after looking into all the materials.

Therefore, this Court is not inclined to reconsider

Patna High Court Cr.Misc. No.60985 of 2018 (2) dt.31-10-2018 2/2 the prayer of the petitioner for grant of anticipatory bail. This application is, accordingly, dismissed.

Petitioner is directed to surrender before the Court below within a period of four weeks and seek regular bail, which shall be considered and disposed off in accordance with law, preferably on the same day, without being prejudiced by this order.
