2.The petitioner is not named in the F.I.R. and apprehending his arrest in connection with Civil Line P.S. Case No. 163 of 2023 registered for the offences punishable under Sections 147, 48, 332, 333, 353, 504, 506 of the Indian Penal Code.
3. The allegation against petitioner is to assault police personnels and also to deter them in discharging their official duties, while police personals were engaged in controlling the crowd at physical examination center, where recruitment process for Bihar Home Guard was under progress.

It is submitted by learned counsel appearing on behalf of the petitioner that the petitioner was not named with FIR and he was implicated only for the reason that his motorcycle bearing registration no. BR 97 D 4744 found parked near to the place of occurrence. It is submitted that in similar way on the basis of registration number of parked motorcycles, several other co-accused persons were implicated with present case having otherwise no connection with the occurrence. While concluding arguments, it is submitted that above named petitioner is a man of clean antecedent.
5. Learned APP, opposed the prayer of bail.

In view of aforesaid factual submissions and by taking note of fact as implication of petitioner primafacie appears without any over tact, rather on the basis of his motorcycle parked near to the place of occurrence, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks of this order, is directed to be released on

No.22666 of 2025(2) dt.30-04-2025 3/3 bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM 1st Gaya /concerned Court, where the case is pending in connection with Civil Line P.S. Case No. 163 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C/ Section 482(2) of BNSS.
