The petitioner seeks bail in connection with Madhepura/Ghailadh (O.P.) P.S. Case No. 500 of 2018 instituted for the offence under Section(s) 420, 467, 468 and 471 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner has been made accused in this case merely on suspicion. No loan as alleged in the written report was sanctioned in favour of the petitioner.
The A.S.I. of Ghailadh O.P. has filed FIR alleging that this petitioner applied for grant of loan under the PMY loan Scheme using forged seal and signature of DIG office Saharsa. Learned counsel for the petitioner has submitted that
Patna High Court Cr.Misc. No.68150 of 2018(2) dt.28-11-2018 2/2 hand writing of the petitioner was not even sent for any examination as mentioned in para 15 of the bail petition. There is no recovery of any seal of the DIG office from the possession of this petitioner.
Petitioner is in custody since 5.7.18 having clean antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Madhepura (Ghailadh) P.S. Case No. 500 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
