====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 11-12-2015 Heard the learned counsel for the petitioner. By the impugned order dated 17.09.2014 passed by Sub Judge IX, Muzaffarpur in Title Suit No.561 of 2009, the Court below rejected the application filed by the petitioner to mark the documents obtained by the petitioner according to the provision of Right to Information Act, 2005. From perusal of the impugned order, it appears that the Court below assigned the reason that the bank officer is not a public servant and the documents produced by the petitioner is also not a public document. Therefore, liberty has been granted to the petitioner to get the said documents marked at the time of examination of the petitioner as witness. In view of the above facts and circumstances of the case, when liberty has already been granted, there is no question of any prejudice to the petitioner arises nor impugned order occasioned any failure of justice. Thus, this writ application is dismissed.
