The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 341, 323, 308, 379, 504 and 506 of the Indian Penal Code. The petitioner along with 10 named persons and 5 unknown persons looted gold chain, watch and cash of Rs.5,000/-.

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case due to village rivalry. The allegation is general and omnibus against 15 persons including 10 named and five unknown. The injury sustained by the informant is simple in nature and similarly situated co-accused persons have already been granted bail vide

Patna High Court CR. MISC. No.20131 of 2023(2) dt.24-06-2023 2/2 order dated 13.04.2022 of 2019 passed in Cr. Misc. No. 65159 of 2019 (Annexure-3) to the bail petition. The petitioner has no criminal antecedent as stated at para 3 of the bail petition. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Biroul, Darbhanga, in connection with Ghanshyampur P.S. Case No. 133 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
