The petitioner has preferred this application for grant of regular bail in a case registered under sections 379, 461 and 411 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, the accused persons are stated to have made an attempt to commit theft in the house of the temple where the maize belonging to the informant was stored. It is stated that while the other accused persons managed to escape, the petitioner was caught.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He was apprehended under a misunderstanding. He is in custody

Having heard learned counsel for the parties and taking into consideration the facts of the case, the allegation in the FIR and the petitioner having remained in custody for 1 year 5 months, the petitioner is directed to be enlarged on bail in connection with Korha P.S. Case no. 361 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class no.
