JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)a, 26 of the Arms Act. The informant was investigating Fulkaha P.S. Case No. 32 of 2016 in which petitioner was made accused and in that course, informant got confidential information that petitioner had concealed firearms in his house and thereafter, informant raided the house of the petitioner and one country made pistol and one cartridge kept in a drum were recovered from the house of the petitioner.

Submission on behalf of the petitioner is that nothing

Patna High Court Cr.Misc. No.36325 of 2016 (2) dt.23-08-2016 2/2 was recovered from the house of the petitioner and as a matter of fact, this false case has been brought by the informant at the instance of informant of Fulkaha P.S. Case No. 32 of 2016 and moreover, petitioner is in jail custody since 05.05.2016 and except the aforesaid Fulkaha P.S. Case No. 32 of 2016, not a single case had been registered against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Ashish Ranjan, Judicial Magistrate 1st Class, Araria in connection with Fulkaha P.S. Case No. 33 of 2016.
