The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 143, 323, 188, 353, 431, 504, 506 of the Indian Penal Code.
Prosecution case is that the mob obstructed the police to preparing the inquest report and taking the dead body of the deceased for post mortem, who died in accident. The accused persons also blocked the road and threby obstructed the police personnel to discharging official duty.
It is submitted by the learned counsel for the petitioners that accusation is against mob. The deceased died
Patna High Court Cr.Misc. No.37830 of 2015 (2) dt.18-09-2015 due to rash and negligent driving of the vehicle. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate Sherghati in connection with Sherghati (Dobhi) P.S. Case No. 118 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
