JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case initially, registered for the offences punishable under Sections 457, 380 of the Indian Penal Code and subsequently, Sections 411, 461, 379 of the Indian Penal Code were added.

Petitioners are not named in the first information report and the impugned order goes to show that nothing was recovered from their conscious possession. However, the name of petitioners appears to have come in this case on the basis of suspicion.

No doubt, petitioners do have some criminal antecedent but considering the aforesaid facts and circumstances as well as this aspect of the matter that having similar allegation,

No.46500 of 2016 (2) dt.24-10-2016 2/2 some co-accused have already been granted privilege of bail, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Benipur, Darbhanga in connection with Bahera P.S. Case No. 507 of 2015, subject to condition that one of the sureties must be local and holder of landed property.
