Mr. Rajkishore Singh ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 06-10-2018 I have heard learned counsel for the petitioners and the State.

The petitioners seek bail in a case registered for offences punishable under Sections 272 and 273/34 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 287 litres 250 Ml of foreign liquor was recovered from a car which was being driven by the petitioner no. 1 and petitioner no. 2 was sitting in the car. It is contended that nothing has been recovered from the conscious possession of the petitioners and they have been falsely implicated in the present case. Petitioners claim that they are having clean antecedent and are in custody since 08.07.2018.

No.58232 of 2018(2) dt.06-10-2018 2/2 Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, East Champaran at Motihari, in connection with Dumariaghat P.S. Case No. 110 of 2018 with further conditions that one of the bailors of the petitioners must be the resident of State of Bihar. If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
