2. The petitioner seeks bail in connection with Cyber P.S. Case No. 05 of 2023 registered for the offences under Sections 406, 419 and 420 of the IPC & Sections 66(C) and 66(D) of the IT Act.
3. The petitioner is named in the F.I.R. and is in custody since 14.08.2024.
4. The allegation against the petitioner is to cheat money from informant by investing money against false pretext of higher return.
5. Learned counsel appearing on behalf of the petitioner submitted that petitioner is a labour class man and he was in fact
Patna High Court CR. MISC. No.20754 of 2025(5) dt.17-09-2025 2/3 cheated by his friend namely Devraj, resident of P.S. Vijay Nagar, District Ajmer, Rajasthan. It is submitted that out of said acquaintance/friendship he called this petitioner along with one common friend namely Rameshwar Lal (Bairwa) at Kolkata and took their signatures for starting business in the name of M/s. Shivam Textiles and M/s. Swati Textiles through which present fraud was committed. It is submitted that all these facts can be gathered from the confessional statement of petitioner. It is submitted the entire fraud was committed by co-accused Devraj and not by this petitioner. It is also submitted that considering the nature of allegation and the period of sentence police issued notice under Section 41(A) of the Cr.P.C.
to this petitioner, but due to certain reasons petitioner could not produce before the police during the course of investigation and, therefore, he was arrested in connection with the present case. It is also submitted that bank account was opened in the name of this petitioner, but was operated by co-accused Devraj and, therefore, petitioner cannot be said at fault for having any intention to cheat innocent people as alleged. While concluding the argument it is submitted that, petitioner also found involved in Jaipur Cyber P.S. Case No.
Patna High Court CR. MISC. No.20754 of 2025(5) dt.17-09-2025 3/3 such, there is no chance of tampering with the evidence.

Learned APP appearing on behalf of the State, while opposing the prayer for bail submitted that petitioner found involved in the the present occurrence as the firm which accepted money from informant was in the name of this petitioner. Learned APP could not disputed the factual submission as advanced in view of materials available on record.
7. In view of aforesaid factual submission and by taking note of fact as thrust of allegation is available against co-accused Devraj and not against this petitioner, coupled with the fact as petitioner remains in custody since 14.08.2024, accordingly above named petitioner, is directed to be released on bail in connection with Cyber P.S. Case No. 05 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar/concerned court, subject to the conditions as mentioned under Section 480(3) of the B.N.S.S.
