Petitioner prays for bail in connection with Mithanpura P.S.Case No. 157 of 2018 registered for the offences punishable under Sections 20, 22 and 39 of N.D.P.S Act.
Allegation against the petitioner is of recovery of one and a half kilogram of ganja from his possession and further petitioner is accused in one more case of similar type.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody since 19.5.2018 and charge sheet has bee submitted in this case. Heard learned APP also, who has opposed the prayer for bail.
Having heard both sides and in view of allegation as well
Patna High Court Cr.Misc. No.58128 of 2018 (2) dt.08-10-2018 2/2 as criminal antecedent, I am not inclined to grant bail to the petitioner at this stage.
However, once charge has been framed in this case, learned trial court shall release the petitioner on bail to its own satisfaction on the condition that he will co-operate in disposal of trial and remain present in court as and when required. With the above observation, this application is disposed of.
