JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-03-2017 Heard learned counsel for the petitioners, learned counsel for the informant and the learned A.P.P. for the State. The petitioners apprehend their arrest in connection with Akbarpur P.S. Case No. 159 of 2016, registered under Sections 465, 467, 468, 471, 386, 120(B), 504, 354(D)(ii) of the Indian Penal Code.

The accusation is that marriage of daughter of complainant-informant was settled with Md. Hasan Khan, son of Monazir Hasan and the date of marriage (Nikah) was fixed on 27.09.2016. On 06.07.2056, informant was called by Md. Monazir Hasan. When, complainant-informant went there then he was

Hasan forwarded through Whatsapp to mobile no. 745980978. In the marriage certificate, the name of bridegroom was Niyaj Khan. Learned counsel for the petitioners submits that both petitioners are parents of Niyaj Khan due to that reason they have falsely been implicated in the present case. Further submission is that petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Nawada, in connection with Akbarpur P.S. Case No. 159 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
