The petitioner is apprehending his arrest in connection with Rosera P.S. Case No.247 of 2013 for allegedly having committed the offence under Sections 364A/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. However, in the statement made by the victim under Section 164 of the Code of Criminal Procedure, the name of the petitioner has surfaced, but there is no specific allegation against him.
Considering the aforementioned submissions and also the fact that since the name of the petitioner has surfaced only
Patna High Court Cr.Misc. No.43497 of 2014 (2) dt.20-03-2015 2/2 on account of confessional statement of co-accused Rakesh Kumar made before the police, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.K. Rajak, learned Additional Chief Judicial Magistrate, Rosera, Samastipur, in connection with Rosera P.S. Case No.247 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
