The petitioner apprehends his arrest in Desari P.S. Case No. 271 of 2016 registered for the offences punishable under Section 325, 354, 379 and other Sections of the Indian Penal Code.

The informant alleged that her elder brother-in-law entered into her house with bad intention and caught her hand. When the informant raised alarm her elder brother-in-law put her down on the ground and Ratnesh Kumar assaulted her with iron rod causing fracture injury on her hand. Rajnish Rai, the petitioner assaulted the informant and snatched her earrings. Learned counsel for the petitioner submits that the petitioner is son of Inarjit Rai. Sanjit Rai, the husband of the informant, and Inarjit Rai are own brothers. On account of some

Patna High Court Cr.Misc. No.18871 of 2017 (2) dt.19-05-2017 2/2 family disputes false case has been filed. The petitioner is alleged to have snatched the earrings but, allegation of snatching is ornamental.

Considering the facts aforesaid and the fact that the petitioner happens to be nephew of the husband of the informant, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Desari P.S. Case No. 271 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
