The petitioners seek bail in a case registered for offences punishable under sections 273 and 273 of the Indian Penal Code and Sections 30 (a) and 37 (b) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 45 litres of countrymade Nepali saufi liquor was recovered from two bags. It is contended that nothing has been recovered from the conscious possession of the petitioners and they have been falsely implicated in the present case with ulterior motive. Petitioners claim that they are having clean antecedents and are in custody

Patna High Court Cr.Misc. No.58109 of 2018(2) dt.06-10-2018 2/2 since 25.07.2018.

Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on their furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Exicse, East Champaran at Motihari in connection with Adapur P.S. Case No. 209 of 2018. If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
