Petitioners pray for bail in connection with Bihariganj P.S.Case No. 133 of 2018 registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code. Allegation against the petitioners is of forcing the deceased to climb on the electric pole, as a result of which deceased died by receiving electric shock.

Submission of learned counsel for the petitioners is that no case is made out under Section 302 IPC, rather it is a case of 304 IPC and petitioners have falsely been implicated in this case due to political rivalry and they are in custody for about three months.

Having heard both sides and in the facts and circumstances, let the petitioners, named above, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri Abhimanyu Kumar, Judicial Magistrate, 1st Class, Uda Kishunganj, District Madhepura, in connection with Bihariganj P.S.Case No. 133 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
