Petitioner is in custody since 09.01.2020 and seeks bail in connection with Bariyarpur P. S. Case No.75 of 2011 registered for the offences punishable under Sections 379 and 411 of the I.P.C.

Petitioner is not named in the first information report, but in course of investigation, the name of petitioner came in this case on the basis of confessional statement of co-accused. However, the house of petitioner was raided and some iron rods were recovered from his house, but there is nothing on the record to show that the recovered items were of the stolen

Patna High Court CR. MISC. No.20315 of 2020(4) dt.05-10-2020 2/2 property. Petitioner does not have any criminal antecedent as it appears from perusal of Para-3 of the petition. No doubt, petitioner could be remanded in this case on 09.01.2020, but considering the aforesaid facts and circumstances of the case as well as period of detention of petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Munger in connection with Bariarpur P. S. Case No.75 of 2011.
