Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.

Prosecution case is that 84 liters Nepali wine from four jut bags were recovered.

It is submitted on behalf of the petitioner that petitioner has been made accused in this case merely on the basis of suspicion. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the State submits that petitioner has got one criminal antecedent of similar nature.
