The petitioner is in custody since 15.06.2018 in connection with Ahiyapur P.S. Case No.640 of 2018 registered for the offence under Sections 401 and 411 of the Indian Penal Code.
Learned counsel for the petitioner submits that the alleged recovery of motorcycle was made from the possession of Arvind Kumar and not from the present petitioner. It is further submitted that only because the petitioner had refused to sign on the seizure list, he was taken into custody. It is further submitted that the petitioner is not having any criminal antecedent and is languishing in jail for no fault of his. Considering the aforementioned facts and
