JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, the name of petitioner came in this case on the basis of information given by spy of police and, thereafter, petitioner was arrested and made his confessional statement. Petitioner is in jail custody since 19.06.2016 but I.O. did not take pain to put the petitioner on T.I.P. and Para-38 of the case diary goes to show that concerned I.O. submitted charge sheet against the petitioner only on the basis of his confessional statement.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.36041 of 2016 (4) dt.25-10-2016 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Siwan in connection with Mairwa P.S.Case No. 91 of 2016.
