Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioners apprehend their arrest in connection with Khagaria Muffasil P.S. Case No. 608 of 2019 registered for the offences punishable under Sections 147, 149, 323, 307, 337, 338, 353 and 120B of the Indian Penal Code.

Learned counsel of the petitioners submits that for the same offence two cases, i.e., present case and one Khagaria Muffasil P.S. Case No. 597 of 2019 was registered and in

Patna High Court CR. MISC. No.20690 of 2020(2) dt.09-10-2020 2/2 Khagaria Muffasil P.S. Case No. 597 of 2019, the petitioners have already been granted privilege of anticipatory bail. Learned counsel of the petitioners, further, submits that the fact of the case reflects that there was bona fide land dispute between the parties and, as a matter of fact, police in conclusion with informant of Khagaria Muffasil P.S. Case No. 597/2019 lodged the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that petitioners, above named, in the event of their arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria/concerned court in Khagaria Muffasil P.S. Case No. 608 of 2019 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
