JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 05-10-2016 The petitioner wants to renew his prayer for bail, which was earlier rejected vide order dated 23.02.2016 passed in Cr. Misc. No. 53902 of 2015, on the ground that the trial has not been concluded within six months, and as such, the petitioner deserves sympathetic consideration as he is suffering in custody since 16.05.2015.
Learned A.P.P. opposes the prayer of bail by submitting that the learned court below has sought further six months time to conclude the trial in Cr. Misc. No. 53902 of 2015. In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of bail, again prayer of bail of the petitioner stands rejected.
However, considering the detention of the petitioner, the learned trial court is directed to expedite the trial and conclude

No.40170 of 2016 (2) dt.05-10-2016 2/2 the same as early as possible, preferably within six months from the date of receipt/production of a copy of this order by keeping the same on day to day basis, failing which the petitioner, if at no fault, may renew his prayer for bail.
