2. The petitioner apprehends his arrest in connection with Forbesganj P.S. Case No. 327 of 2018 registered under Section 379 of the Indian Penal Code.
3. The F.I.R. is registered against unknown person for theft of motorcycle.
4. Submission of learned counsel for the petitioner is that petitioner is not named in the First Information Report. The name of the petitioner has come during course of investigation. Nothing has been recovered from the conscious possession of the petitioner.
5. Learned A.P.P. appearing on behalf of the State
Patna High Court CR. MISC. No.26868 of 2024(4) dt.29-08-2024 2/2 vehemently opposed the prayer for bail and submits that though the F.I.R. is registered against unknown person, but during course of investigation, the police has recovered stolen motorcycle of this case in Fulkaha P.S. Case No. 115 of 2018 from the possession of this petitioner. It is further submitted that petitioner has got five criminal antecedents. Hence, he does not deserve the privilege of anticipatory bail.
6. Having considered the nature of accusation and the long criminal history of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for bail of the petitioner is rejected.
