Imran, in connection with Beldaur Police Station Case No. 219 of 2014, under Section 392 of the Indian Penal Code.
Perused the above application and materials on record.
Heard Mr. Ram Sumiran Rai, learned Counsel for the petitioner, and Mr. Harendra Prasaad, learned Additional Public Prosecutor, appearing on behalf of the State. Mr.
Ram Sumiran Rai, learned Counsel, appearing on behalf of the petitioner, has submitted that the co-accused, Sanjeet Thakur, in whose confessional statement before the police, the name of the present
Patna High Court Cr.Misc. No.45420 of 2016 (2) dt.19-10-2016 2/3 petitioner transpired, has already been granted bail by order, dated 15.12.2015, passed in Criminal Misc. No. 48887 of 2015.
In view of the above submission and the fact that the accused above-named has been in custody since 18.09.2016 in connection with the case aforementioned and though charge sheet has been submitted and perusal of the materials available on record does not reveal such incriminating materials, which would warrant further detention of the accused-petitioner in custody, and in view also of the fact that the perusal of the materials does not reveal that the accused-petitioner's liberty on bail would adversely affect his trial, it is, in the interest of justice, hereby directed that the accused above-named shall be released on bail of Rs. 10,000/- with two sureties, each of the like amount, subject to the satisfaction of Shri P. C. Verma, Judicial Magistrate, 1st Class, Khagaria, in connection with Beldaur Police Station Case No. 219 of 2014.
