JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-11-2020 The office has pointed out some defects to which learned counsel of the petitioner submits that he will remove the aforesaid defect when the court starts normal function. Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Khagaria Muffasil P.S. Case No. 608 of 2019 registered for the offences punishable under Sections 147, 149, 323, 307, 337, 338, 353/120B of the Indian Penal Code.

The accusation against the petitioners is that they having formed unlawful assembly attacked on the police party.

No.20806 of 2020(2) dt.05-11-2020 2/2 However, written report of the present case goes to show that for the same occurrence one Khagaria Muffasil P.S.Case No. 597 of 2019 was lodged against the petitioner and the present case was lodged after one day of alleged occurrence. Moreover, as per submission, on behalf of the petitioenrs, petitioners have already been granted bail in Khagaria Muffasil P.S.Case No. 597 of 2019. Learned counsel for the petitioner submits that having more or less similar allegation some co-accused have already been granted privilege of anticipatory bail by this Court.

In view of the aforesaid submission, let the petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in Khagaria Muffasil P.S. Case No. 608 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
