The petitioners apprehend their arrest in Bhagwanpur P.S. Case No. 190/2014, registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code. The mother of the deceased made allegation that Khusbu Devi her daughter was married to Shambhu Mahto in the month of June, 2010 and thereafter her husband started subjecting her to physical and mental torture. Shambhu Mahto extracted money from the informant many times and ultimately Khusbu Devi was burnt to death on 31.10.2014.
It is submitted that the petitioners are mother-in-law and father -in-law of the deceased. The informant had not made
Patna High Court Cr.Misc. No.37637 of 2015 (4) dt.01-12-2015 2/2 any sorts of allegation of demand of dowry and torture against the petitioners. The informant did not lodge any complain or case against the petitioners, while her daughter was alive. There was dispute between the husband and the wife. The petitioners have no manner of concerned with the family affairs of the deceased and her husband. The informant made omnibus and general allegation that the petitioners also involved in killing of her daughter and also many villagers who participated in concealing of dead body.
Considering the facts aforesaid, the petitioners who are mother-in-law and father-in-law of the deceased above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Rajesh Kumar Dwivedi, Judicial Magistrate 1st Class, Begusarai in connection with Bhagwanpur P.S. Case No. 190/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.)
