The petitioner is in custody in a case registered under Sections 341,447, 323,354, 307,302 and 504/34 of the Indian Penal Code.
The allegation against the petitioner is that he along with other accused persons constituted unlawful assembly and committed the murder of Jawahar Singh, uncle of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.03.2016. Charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is said to be a member of unlawful assembly. No specific injury has been attributed against the petitioner. Specific allegation has been made
Patna High Court Cr.Misc. No.45833 of 2016 (2) dt.21-10-2016 2/2 against Arun Singh for assaulting the deceased. It has been submitted on behalf of the State that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Ahiyapur P.S.Case No. 229 of 2016.
