In this case, the petitioners are seeking anticipatory bail in connection with Danapur P.S. Case No. 466 of 2018, registered for the offence under Sections 420, 406 and 468/34 of the Indian Penal Code.

Allegation has been made that the petitioners have shown their intention to sale the house, for that a consideration amount of Rs.36, 51,000/- has been paid, but neither the money has been returned nor the sale deed has been executed in favour of the informant.

Patna High Court CR. MISC. No.18355 of 2019(2) dt.27-03-2019 2/2 Learned counsel for the petitioners submits that the husband of petitioner no.2 is in jail and they are family members.

Looking to the entire facts and circumstances of the case, let the above-named petitioners, be released on provisional bail for six month in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the A.C.J.M.-1, Danapur, Patna, in connection with Danapur P.S. Case no. 466 of 2018 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that the petitioners shall deposit Rs.5,00,000/- before the Court below within six months from today. In failure to deposit the aforesaid amount within six months from today, this order will be treated to have been cancelled. If the petitioners deposit the amount, as has been stated hereinabove, then their provisional bail will be confirmed.
