JUSTICE SUDHIR SINGH ORAL ORDER 30-07-2015 The petitioners are apprehending their arrest in connection with Raxaul P.S. Case No. 306 of 2013 for the offences instituted under Sections 302, 201 and 120(B) of the IPC. Heard learned counsel for the petitioners and learned counsel for the State.

The accusation is of killing the sister of the informant after eleven years of marriage.

It has been submitted on behalf of the petitioners that the petitioner no. 1 is the uncle-in-law, petitioner no. 2 is the brotherin-law and petitioner no. 3 is the mother-in-law of the deceased. It has been submitted on behalf of the petitioners that the petitioners

Patna High Court Cr.Misc. No.30910 of 2015 (2) dt.30-07-2015 2/2 have got no criminal antecedent. The petitioners have been made accused in the present case due to mistake of fact. The body of the deceased was found near the Naihar of the deceased. The husband of the deceased has already been granted regular bail by this Hon'ble Court vide Cr. Misc. No. 58 of 2015.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Raxaul P.S. Case No. 306 of 2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Raxaul at Motihari, East Champaran, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
