1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Learned counsel for the petitioner fairly submits that charges have been framed and the trial has commenced, it is next submitted that despite charges being framed in the year 2017 but not a single witness till date has turned up for giving evidence, it is further submitted that from perusal of the allegation as alleged in the F.I.R. it would manifest that the dispute related to land, as such the petitioner along with his family members came to be implicated, it is also submitted that since it is a false case, as such, no one is appearing on behalf of the prosecution to give evidence.
3. The learned APP Mr. Chandra Bhushan Prasad
Patna High Court CR. MISC. No.21140 of 2017(3) dt.27-09-2023 2/2 submits that since charges have been framed, the court should refrain from interfering with the criminal proceedings.
4. At this stage, the learned counsel for the petitioner seeks permission to withdraw the present quashing application.
5. Permission is accorded.
6. Accordingly, the present quashing application is dismissed as withdrawn.
7. However, the Court expects that the learned trial court shall conclude the trial expeditiously and preferably within a period of one year from the date of production of a copy of this order as prolonged criminal trial causes mental agony. (Satyavrat Verma, J) amit/- U T
