Petitioner seeks bail in connection with Banka Mahila P.S. Case No. 23 of 2018 registered for the offence punishable under section 376 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to dirty village politics and previous land dispute. In this case cognizance has been taken under section 376/511 As a matter of fact, both parties were consenting parties as no hulla or protest was raised by the informant at the time of the alleged occurrence. Petitioner is a man of clean antecedent and is in custody since 18.05.2018.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the

No.61328 of 2018(2) dt.08-10-2018 2/2 petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Banka in connection with Banka Mahila P.S.
