Petitioner apprehends arrest in connection with Danapur P.S. Case No. 861 of 2019 registered for the offence punishable under section 498A of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Petitioner being the husband got her treated time to time which is evident from the medical documents annexed 3 (series) and 4(series). Petitioner has no criminal antecedent and is in custody since 17.01.2019. Learned Addl. P.P. appearing for the State opposes

Patna High Court CR. MISC. No.20868 of 2020(5) dt.16-11-2021 2/2 the prayer for bail and submits that petitioner being the husband was responsible for taking care of the informant in which he failed and ultimately she died. Petitioner, therefore, does not deserve to be granted the privilege of bail.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
