This is a petition for grant of anticipatory bail for offence under Section 409 of the Indian Penal Code. The allegation of defalcation of public money is against the In-Charge Headmaster, Nitya Nand Paswan, who was responsible for the construction of the school building and defalcated the money. The petitioner is not named in the first information report.

However, submission of the petitioner is that the petitioner's name was dragged only because the petitioner was posted there as a Panchayat Secretary. Considering the fact that there is no substantial material against the petitioner, the petitioner, above named, in the event of her arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.8338 of 2017 (2) dt.09-03-2017 2/2 each in connection with Barari (Semapur) P.S. Case No. 240 of 2015 to the satisfaction of the Additional Chief Judicial Magistrate, V, Katihar, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
