JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-02-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Moro P.S. Case No. 42 of 2013, registered for the offences punishable under Sections 306, 309/34 of the Indian Penal Code. Allegedly, the petitioner and his wife Kamni Devi consumed sulphas to end their life and during treatment Kamni Devi died, but the petitioner was saved Submission is of false implication and that petitioner is not named in the F.I.R, there is no allegation that he ever tortured his wife, the petitioner is himself the victim and, as such, the petitioner deserves sympathetic consideration. In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Moro P.S. Case No. 42 of 2013, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
