Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 47 of Bihar Excise (Amendment) Act, 2016.

40 litres country made liquor is said to have been recovered from Palani of the petitioner. Petitioner was caught on the spot but submission on behalf of the petitioner is that the present case was lodged by the police at the instance of one Shyamlal Ram with whom petitioner has inimical term and that is the reason the son of aforesaid Shyamlal Ram appeared as witness

Patna High Court Cr.Misc. No.46902 of 2016 (3) dt.08-12-2016 2/2 on the seizure list. Petitioner is in jail custody since 25.07.2016 and does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Barharia P.S.
