JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Sadar (Maddy O.P.) P.S. Case No.52 of 2020 registered under Sections 399 and 402 of the Indian Penal Code besides Sections 25(1b)A, 26 and 35 of the Arms Act. The accusation is that on receiving the secret information about gathering of the miscreants with Scorpio vehicle in between Reliance Pump and Sobhan, the informant along with other police personnel reached there. On seeing the police party, five persons, present near the Scorpio vehicle, started to flee away but, on chase, they were apprehended, who disclosed their name as Lalit Kumar Rai (petitioner), Raja
Patna High Court CR. MISC. No.18711 of 2020(2) dt.09-06-2020 2/2 Kumar, Amar Kumar Sahni, Dinesh Sahni and Munna Das. On search, the petitioner was found in possession of one mobile set, Raja Kumar was found in possession of one mobile set and cash Rs.400/-, Amar Kumar Sahni was found in possession of one loaded country made pistol, one mobile set and cash Rs.6500/-, Dinesh Sahni was found in possession of one mobile set and one knife and Munna Das was found in possession of one mobile set and one knife.
Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent and is in custody since 06.02.2020. On investigation, the police has already submitted the chargesheet against the petitioner. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with Sadar (Maddy O.P.)
