JUSTICE ASHUTOSH KUMAR) 10-05-2022 Heard Mr. Rajesh Prasad Choudhary, learned Advocate for the appellant/Veer Kunwar Singh University and Mr. Raju Giri for the Respondent No. 4, the college in question. By order dated 06.02.2020 passed by the learned Single Judge in CWJC No. 25621 of 2019, it was directed that the affiliation be granted to the respondent/college forthwith and the portal for admission be opened for admission in Sessions

Patna High Court L.P.A No.246 of 2020(4) dt.10-05-2022 2/3 2019-22 in B.A., B.Sc. and B.Com (Honours) course subjects, subject to the condition of the respondent/college fulfilling and upgrading the laboratory within three months of the issuance of the letter of affiliation.

Mr. Giri, learned Advocate for the respondent, however, has informed this Court that this order passed by the learned Single Judge was never acted upon but the college also did not prefer any contempt petition before this Court for nonimplementation of the order, especially with respect to Session 2019-22.

Since no permanent affiliation was given for the Session 2019-22 and consequently the portal of admission also was not permitted to be opened, no admission could be taken for Sessions 2019-22.

With the onset of Session 2020-23, the order passed by the learned Single Judge has been complied with and provisional affiliation has been granted for that session. Mr. Giri has also informed this Court that the State Government has granted affiliation for Session 2021-24 also. Considering this aspect of the matter, Mr. Choudhary, learned Advocate for the appellant does not press this petition any further as the Session of 2019-22 has passed off without any

Patna High Court L.P.A No.246 of 2020(4) dt.10-05-2022 3/3 admission being taken by the respondent/college. No lis, therefore, remains for this Court to decide in this appeal.

The appeal has otherwise become infructuous.

The appeal stands dismissed as having become infructuous.
