====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 01-11-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Section 7 of E.C. Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a P.D.S. dealer and he came to be implicated in the present case on the allegation that he was indulging in black-marketing of food grains. Learned counsel next submits that petitioner during the course of investigation was given the benefit of the provision of Section 41-A of Cr.P.C.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that the petitioner

No.20757 of 2022(2) dt.01-11-2022 2/2 had already received the benefit of Section 41-A of the Cr.P.C., as such, he should surrender and seek bail in terms of the law laid down by this Court in the Case of Mahendra Singh Vs. State of Bihar reported in 2004 (PLJR page 491). Learned counsel for the petitioner at this stage seeks permission to withdraw the anticipatory bail application of the petitioner.

Permission is accorded.

In the event, if the petitioner surrender on or before 16.11.2022, the learned Trial Court shall dispose of the bail application strictly in accordance with the law laid in Mahendra Singh Vs. State of Bihar as aforesaid.
