JUSTICE BIRENDRA KUMAR ORAL ORDER 23-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 392 of the Indian Penal Code. According to F.I.R. some unknown person snatched the motorcycle of the informant. Name of the petitioner transpired in the confessional statement of the co-accused. During investigation one motorcycle of the petitioner was seized, which was in fact in the name of the father of the petitioner and was released in favour of the father of the petitioner as submitted by learned counsel for the petitioner. Petitioner is in custody since 14.07.2016.
Considering the entire facts aforesaid, let petitioner, above named, be enlarged on bail on furnishing bail
Patna High Court Cr.Misc. No.47908 of 2016 (3) dt.23-01-2017 2/2 bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Birpur, Supaul/Successor Court, in connection with Nirmali P.S. Case No.75 of 2016.
