JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 06.10.2018 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Nawadah P. S. case no. 511/2017 registered under sections 467, 468, 420 and 120B of the IPC.

The present case was instituted on the basis of complaint petition filed by the informant and in the aforesaid complaint petition, informant claims that the petitioners being agents of Kotek Life Insurance took near about Rs 30,000/- on different dates from the informant in the name of insurance policy but they did not provide any receipt to the informant nor returned the aforesaid amount.

Learned counsel for the petitioners submits that the informant has already received amount in question which is evident from statement of the bank account of the informant which has been annexed at page 18 of the petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawadah in Nawadah P. S. case no. 511/2017 subject to condition as laid down under section 438(2) of the Cr.P.C. shahid (Hemant Kumar Srivastava,J) U T
