Petitioner seeks bail in K.Hat (Madhubani) P.S. Case No.203 of 2018, registered under Sections 413, 414 and 34 of the Indian Penal Code.

The gist of the allegation is that the petitioner and one another person was going on a motorcycle but when the police signaled them to stop, the petitioner and his accomplice started fleeing away. Petitioner was apprehended on chase and the motorcycle was also recovered.

The learned counsel for the petitioner submits that the another co-accused who managed to flee away handed over the motorcycle to the petitioner. Petitioner does not know who is the owner of the motorcycle. Petitioner is in jail since 28.03.2018. Petitioner has already remained in jail for more than six months

Patna High Court Cr.Misc. No.61653 of 2018(2) dt.08-10-2018 2/2 and he has got no criminal antecedent.

Considering the facts aforesaid that the petitioner has remained in jail for more than six months and have got no criminal antecedent as stated in para 3 of the bail petition on oath, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Purnea in connection with K. Hat (Madhubani) P.S. Case No.203 of 2018.
