2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 302, 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, this petitioner fired with his country made pistol on the temple of nephew of informant. Later on, he succumbed to the injuries.

4. It is submitted that petitioner is lecturer in LBT College Buxar and father of the petitioner is President of that college and Advocate at Buxar. Informant is Principle of that college. Father of petitioner suspended the informant from the post of Principle and being aggrieved the informant lodged this

Patna High Court CR. MISC. No.21231 of 2023(3) dt.13-07-2023 2/2 false case against petitioner and several other college employees. The police after investigation submitted final form no. 560/18 vide Annexure-2 showing the case true but clueless. Thereafter, informant filed a protest petition before the learned court below vide Annexure-3. Other co-accused have been granted bail. Petitioner claims clean antecedents.

Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No. 580 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
