JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code. No doubt, petitioner is not named in the first information report but the impugned order goes to show that he was put on Test Identification Parade and was identified by the informant.

Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Bathnaha P.S. Case No. 104 of 2016 pending in the court of Chief

Patna High Court Cr.Misc. No.46858 of 2016 (3) dt.08-12-2016 2/2 Judicial Magistrate, Sitamarhi stands rejected, at least, at this stage.
