The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 409 and 471 of the Indian Penal Code.
Allegation against the petitioner and other Chairman of the PACS is that the petitioner and others purchased paddy from the farmers who produced fake land possession certificate. It is submitted that there is no allegation that the petitioner misappropriated any amount. The petitioner had no mechanism to detect the fake land possession certificate being produced by the farmers. The price of the paddy was paid through account payee cheques.
Considering the facts aforesaid, the petitioner above
Patna High Court Cr.Misc. No.37872 of 2015 (3) dt.06-11-2015 2/2 named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Sadar, Motihari, East Champaran in Muffasil P.S. Case No. 179 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
