The petitioner seeks bail in anticipation of his arrest in connection with Rupaspur P. S. Case No. 52 of 2015 instituted for the offences under Sections 419 and 420 of the Indian Penal Code.
The petitioner is alleged to have committed cheating in the examination for appointment of constables. The accusation against the petitioner is on the basis of different hand writing in different documents furnished by the petitioner. It has been submitted on behalf of the petitioner that merely because there was some difference in two hand writing samples of the petitioner, he cannot be stated to have resorted to
Patna High Court CR. MISC. No.31484 of 2021(2) dt.19-01-2022 2/2 cheating and impersonation. There could be various reasons for slight difference in two sets of hand writings. One of the accused persons of this case with similar accusation has been granted anticipatory bail by a Bench of this Court vide order dated 30.11.2021 passed in Cr. Misc. No. 22799 of 2021. Considering the afore-noted facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, on his/her furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-II, Danapur in connection with Rupaspur P.S. Case No. 52 of 2015, subject to the condition as laid down under Section 438 (2) Cr. P.C. The application stands allowed.
