Petitioner seeks bail in S.T. Excise Case No.579 of 2018 arising out of Karjain P.S. Case No.96 of 2018 instituted for the offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.
Petitioner is not named in the First Information Report. There is no recovery from his conscious possession. Name of the petitioner has come during investigation in the confessional statement of co-accused. He is in custody since 12.08.2018. He is neither owner of the vehicle nor owner of the wine as mentioned in the written report.
In the facts and circumstances of the case, prayer of
Patna High Court Cr.Misc. No.62159 of 2018 (2) dt.09-10-2018 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-IIcum-Special Judge, Excise, Supaul, in connection with S.T. Excise Case No.579 of 2018 arising out of Karjain P.S. Case No.96 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
